The Jena 6 post about the perps not trying to seriously injure the victim because "They were wearing tennis shoes when they stomped him" got me wondering. Has any one on here heard of other ridiculous defenses at a trial?
Lawyers; can you post, or is there an ethics issue here?
I've got 2 to start things off.
1. At the sentencing for the guy that beat my wife almost to death back in 96, the guy's lawyer said: "Please don't send him to jail, judge, he's never been away from home before." The judge was not amused.
2. During jury selection for a drug possession trial: The judge told the prospective jurors that the accused's defense was that he thought he had used all the coke up. He forgot he had more in another pocket. I didn't get picked for the jury.

I dunno about actual laughable defense excuses, but my sister and I laughed (tragically) at this:

The suspect in the EMU student murder said that he didn't kill the girl, but that he went to rob her room and found her already dead, so he masterbated on her, took some stuff, and left, not telling anyone about the dead girl in the dorm room.

His mother said something to the effect that she didn't believe her son was guilty of murder because he was brought up in the church.

Sort of like the obituaries for some of the gangsters & thugs that you see in the Journal, carrying on about what a wonderful person he was.

I am truly sorry that you and your wife had to go through that kind of situation and trauma afterwards. I don't rightly know what to say............ Sad

You just deal with it and keep on going. After the initial shock, the hardest part was the 18 months of doctors & hospitals. We'll never forget it, but it's behind us. I only brought it up because of the laughable "reason" His lawyer came up with to try to keep him out of prison. He ended up doing 8 years of a 7 to 15 sentence.

It's easy to talk the talk...walking the walk is a little harder. And that's what separates the men from the boys, so to speak.
