Nearly 40 Flint residents will receive an average of $5,500 each under a lawsuit settlement the City Council approved last week that resolves one of two significant sewer backup cases.
The total payout is $215,000. With the approval, the city still faces a similar case filed in 2001 with about 290 plaintiffs that could cost significantly more, said Dean Yeotis, who represents the plaintiffs in both cases.
The remaining case is before the state Court of Appeals after Genesee Circuit Judge Judith A. Fullerton ruled the city was liable for some of the damage. If the court upholds Fullerton, a jury would be convened to consider damages, Yeotis said.
Yeotis contends the city has failed to maintain its sewer system for years despite having millions of dollars available which it used in recent years to keep the city out of bankruptcy instead.
City officials have countered that while there are problems with the sewer system, the backups were caused by "acts of God" that the city had no control over.
