The council says the mayor has appointed people without its approval. The mayor says the council won't act on its current nomination the new fire chief.
Genesee County Circuit Judge Geoffrey Neithercut told both sides that the city is frustrated with the games played by the mayor and council and ordered them to act.
The council must vote on the current nomination for the fire chief position by 5 p.m. on Friday.
The mayor also has the same deadline to submit nominations to the council for two other positions - police chief and parks director.
The mayor appointed temporary directors to all three of those departments months ago.
Both sides seem happy with the judge's decision.
"The only reason that we're in court is with the Flint City Council position that the mayor was not following the provisions of the charter, they asked the court for relief and what you just heard is the court granted that relief," said council attorney Loyst Fletcher.
The mayor's attorney, Fred Robinson, said he got what he wanted. "And I believe we got what we wanted. The council has the obligation to, to act and the court has demanded that they do so."
Both sides say they'll act by Friday.
The mayor's attorney says he's concerned that council will turn down all the mayor's nominations for political reasons.
No word on when council is expected to take a vote.
