Recall petition language submitted to recall Flint Mayor Dayne Walling over police and fire layoffs

Dayne WallingFLINT, Michigan — A Flint Board of Education member who is seeking to recall six fellow board members has now turned his attention to the City of Flint’s leader.

David Davenport said today that he filed recall petition language with the Genesee County Clerk’s office against Flint Mayor Dayne Walling for “jeopardizing the safety of the citizens of Flint.”

Davenport said he filed the petition against Walling in response to him last week pink slipping 80 police and firefighters due to city’s budget problems.

“As a leader of the city, for me to allow money to be top priority over the safety of the citizens of the city is ridiculous,” Davenport said.

Walling said today that Davenport has a right to seek a recall against him but public safety is his top priority.

“I maintain my position that everyone must share in the solution to the city’s budget crisis,” he said. “I have asked for reasonable cost concessions from our public safety unions. We have not been able to reach an agreement yet. The layoff notices are in the mail and we have a window of opportunity here to get an agreement.”

If no agreement is reached with the unions, the layoffs would go into effect in early March, Walling said.

“We’ll have the largest public safety force that this city’s taxpayer force can afford and the more reasonable our unions are, the stronger the system will be,” he said.

A Genesee County Election Commission clarity hearing on the petition language tentatively has been scheduled for 11:30 a.m. March 10 in Genesee Probate Judge Jennie Barkey’s courtroom.

If the language is approved, Davenport will have up to 180 days to collect a to-be-determined number of valid signatures to get the recall on the ballot.

Last week, Flint resident Carolyn Spight submitted recall language against Davenport. A hearing on the clarity of that language is scheduled for 1 p.m. March 1 in Barkey’s court.

Davenport has a credibility problem in starting this recall. Remember the court issue in Jackie Poplar's recall attempt.

Aside from Davenport's credibility being suspect, Adam is right. Time is the problem with a recall. The earliest a recall vote would most likely go before the voters would probably be May of 2011. The primary election for mayor is August of 2011. Even if the recall were successful, Walling would get the boot in May, but would be eligible to run for re-election in the August Primary. What's the point. He will continue to shoot himself in the foot for the next year and half and hopefully the citizens of Flint will wise up and find a viable mayoral candidate. This City needs an enema.

There are elections in August & November of this year. Couldn't the recall be held then?
I agree completely on the enema. Use a fire hose & start at the first floor of city hall.

Dave, You are right about the available voting dates, however, there is a time line involved in the recall process. The necessary time for collecting signatures, having them validated, and scheduling the election would make it nearly impossible from this date to be ready by the August or November elections. That is the reason I predict the May election for the recall. I am intimately familiar with this time line due to my involvement with the Williamson recall effort. I just don't believe this would be a prudent step at this juncture. As I stated, Walling will continue to step on his unit and we can get rid of him next November.

Wow, such a choice we are given as residents of this fine city for people to be our mayor. A man who has an impressive academic record but no real world experience ( Dayne Walling) and man who has done what with his life? ( Greg Eason) . Oh yea, didn't he oversee some organization that had some problems with their funding and all that stuff? And now Dayne , a committed Democrat wants to try to put the squeeze on the unions to give concessions . This is amusing, so amusing. Oh wait, this isn't a sit com is it! Shocked , HOLY CRAP , this is Flint! Now if Mikey Moore would make a movie about this mess even I would pay to see it, maybe he can write a better ending than I see coming for the people of Flint.

Just vote his ass out during the regular scheduled election next year!! Why waste the money? I bet I know 100 people that voted for him that now will not.
